Our assessor is a qualified healthcare professional with many years of experience working with adults in complex clinical and legal settings. Assessments are conducted with sensitivity, rigour, and full compliance with the MCA 2005 and its accompanying Code of Practice.

Professional QualificationRegistered healthcare professional with a recognised qualification in mental health or allied health, with specialist experience in capacity assessment.
Clinical ExperienceExtensive experience assessing adults across a range of settings including community, inpatient, and residential care environments.
Legal & Court of Protection WorkExperienced in preparing reports for Court of Protection proceedings, solicitors, and multi-disciplinary care planning teams.

The Legal Framework

Understanding the Mental Capacity Act 2005

All assessments are conducted in full accordance with the Mental Capacity Act 2005 (MCA) and its statutory Code of Practice. The MCA provides the legal framework for making decisions on behalf of adults who may lack the capacity to make specific decisions for themselves.

Presumption of capacityEvery adult must be assumed to have capacity unless it is established that they lack it.

Supported decision-makingA person must be given all practicable help to make a decision before they can be treated as lacking capacity.

Right to make unwise decisionsA person is not to be treated as lacking capacity merely because they make a decision others consider unwise.

Best interestsAny act done or decision made for a person who lacks capacity must be in their best interests.

Least restrictive optionBefore any act is done or decision made, consideration must be given to whether the purpose can be achieved in a less restrictive way.
